Gift of Deed – Transfer of Equity Service
Fixed fee: £400
Transferring a share of a property as a gift can be a minefield of forms, technical wording and Land Registry requirements. My Gift of Deed – Transfer of Equity Service is designed to handle that for you from start to finish, for a fixed fee of £400.
This service is ideal if you want to:
-
Add a spouse or partner to the title
-
Remove a co‑owner and gift your share
-
Re‑balance ownership so that you hold the property as tenants in common in equal shares (or other agreed shares)
-
Make a straightforward gift of equity where no money changes hands
What’s included
For the fixed fee of £400, we will:
-
Review your situation
-
Check who currently owns the property and how it is held
-
Confirm what you are trying to achieve (for example, gifting 50% to a spouse)
-
-
Prepare the Land Registry forms
-
Draft a tailored TR1 – Transfer Deed for a gift of equity
-
Draft the AP1 – Application to change the register
-
Ensure the declaration of trust and tenants in common / joint tenants position is clearly recorded
-
-
Get the details right
-
Calculate and set out the value of the share being transferred
-
Make sure the correct Scale 2 fee is used
-
Include the right execution clauses so the Land Registry can see the witness has signed correctly
-
-
Guide you through signing
-
Provide clear instructions for the transferor, transferee(s) and witness
-
Explain where to sign, how to date the deed and what ID is needed
-
-
Prepare your submission pack
-
Assemble the TR1, AP1, ID1s (if required) and covering letter
-
Give you a step‑by‑step checklist for posting everything to HM Land Registry
-
What’s not included
To keep this service focused and affordable, the £400 fixed fee does not include:
-
Stamp Duty Land Tax (SDLT) advice or returns
-
Independent legal advice for any party
-
Advice on matrimonial, insolvency or tax consequences
-
Complex trust arrangements or bespoke declarations of trust
-
Dealing with mortgage lenders or obtaining their consent
If you need any of the above, I will flag this at the outset so you can obtain separate legal or tax advice.
Who this service is for
This service is suitable where:
-
The property is registered at HM Land Registry
-
There are no mortgages, or the lender has already confirmed how they want the transfer to proceed
-
The parties are broadly in agreement and the gift is straightforward
-
You want help getting the forms and wording right, without paying full conveyancing fees
If your situation is more complex (for example, multiple properties, disputes between co‑owners, or significant tax planning), I will tell you honestly if this fixed‑fee service is not appropriate.
How it works
-
Initial information
You complete a short questionnaire and provide a copy of your Land Registry title and ID documents.
-
Drafting
I draft the TR1 and AP1 and send them to you for approval, together with a clear signing guide.
-
Signing
You arrange a signing appointment with your chosen witness and follow the step‑by‑step instructions.
-
Submission
You post the signed documents and cheque for the Land Registry fee, using the covering letter I provide.
-
Follow‑up
If the Land Registry raises any routine requisitions about wording or form layout, I will help you respond as part of the original £400 fee.
